CHAPTER I

GENERAL PROVISIONS

  1. This Privacy Policy (the “Policy”) governs the principles of personal data processing conducted by UAB Punuta, address Saulės str. 2A, Anavilis, Vilnius district, e-mail rytis.petrauskas.87@gmail.com, company code 305253494 (the “Controller”), as well as the principles of operation of https://www.punuts.eu/ (the “Website”), which is a website managed by the Controller.
  2. This Policy is intended for those individuals who visit the Website (https://www.punuts.eu/) of this Company, and use the information and services provided in the Website.
  3. The Data Subject for the purposes of this Policy is any natural person whose personal data is processed by UAB Punuta.
  4. By using the services, by continuing to browse the Website, the Visitor (user of the Website) confirms that he/she has read the Policy, understands its provisions and agrees to be bound by this Policy.
  5. The Controller ensures that, when adopting and implementing this Policy, it seeks to implement the following fundamental principles related to the processing of personal data:
    • Personal data shall be processed lawfully, fairly and in a transparent manner in relation to the Data Subject (“lawfulness, fairness and transparency”);
    • Personal data shall be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
    • Further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes (“purpose limitation”);
    • Personal data shall be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (“data minimization”);
    • Every reasonable step must be taken to ensure that personal data are accurate and, where necessary, updated within a reasonable time-limit following their change;
    • Every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased immediately or rectified within a reasonable time-limit (“accuracy”).
    • Personal data shall be kept in a form which permits identification of Data Subjects for no longer than is necessary for the purposes for which the personal data are processed;
    • Personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required in order to safeguard the rights and freedoms of the Data Subject (“storage limitation”).
    • Personal data, with respect to the general nature of the personal data processed by the Controller, shall be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures (“integrity and confidentiality”);
    • The controller shall be responsible for, and be able to demonstrate compliance with, the above principles (“accountability”).

This Policy is based on Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/ EC (the “GDPR”), the Law on Legal Protection of Personal Data of the Republic of Lithuania (the “LLPPD”) and other legal acts of the European Union and the Republic of Lithuania. The terms used in the Policy are understood as they are defined in the GDPR and the LLPPD.

CHAPTER II

ON WHAT GROUNDS WE ARE PROCESSING YOUR PERSONAL DATA

  1. UAB Punuta collects and processes personal data in accordance with the legal acts of the EU and the Republic of Lithuania regulating personal data protection. The Company processes personal data on the website on the following grounds:

  3. For the purpose of implementation of our legitimate interests (e.g. administering the Website and ensuring its proper functioning);
  4. So that we could fulfil our obligations under the legal acts.
  5. The Company seeks to process personal data accurately, fairly and lawfully, only for the purposes for which they were collected, in accordance with clear and transparent principles and requirements for the processing of personal data laid down by law.

CHAPTER III

INFORMATION ON COOKIES USED

  1. The Controller uses cookies on the Website in order to distinguish between users of the Website. By using cookies, the Controller seeks to provide a more enjoyable experience for people browsing the Website and to improve the Website itself.

CHAPTER IV

PROCESSING OF PERSONAL DATA FOR OTHER PURPOSES

HOW LONG WE PROCESS AND STORE YOU DATA

    • There are reasonable suspicions of conduct of an illegal activity which is being investigated;
    • Your data are necessary for a proper resolution of a dispute or a complaint;
    • If we have received complaints related to the Visitor or if we have noticed any violation by the Visitor concerned;
    • For backup and other purposes related to operation and support of information systems and for other similar purposes;
    • In the case of other special grounds, conditions or circumstances provided for by the legal acts.

IN WHAT CASES AND TO WHAT THIRD PARTIES WE DISCLOSE YOUR PERSONAL DATA

  3. In each case, we only provide the processor with the data necessary to complete a specific order or provide a specific service.
  4. The data processors we employ may process your personal data only in accordance with our instructions. What is more, they must ensure the security of your data in accordance with applicable law and written agreements with us.
  5. Data may also be provided to competent governmental authorities or law enforcement bodies, such as the police or supervisory authorities, but only on request and only when required by applicable law or in the cases and under procedures provided by law in order to protect our rights, security of our buyers, employees and resources, to bring, enforce and defend legal claims.

YOUR RIGHTS

  1. Legal acts governing data protection grant you many rights in relation to the processing of your personal data.
  2. You have the right to access your personal data processed by us:
    • You have the right to request confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, request access to the personal data processed by us.   3. You have that right to request rectification of your personal data which are inaccurate.

CHAPTER VIII

FINAL PROVISIONS

  1. The legal relations related to this Policy shall be governed by the law of the Republic of Lithuania.
  2. The Data Controller shall not be liable for any damage, including damage resulting from interruptions in the use of the Website, for loss of or damage to data caused by the acts or omissions, errors, wilful harm and other inappropriate use of the Website by the person himself/herself or third parties acting with the person’s knowledge..
  3. The Data Controller shall not be liable either for interruptions in connection and/or use of the Website and/or damage caused by them due to the acts or omissions of third parties unrelated to the Data Controller or the person, including power, internet access interruptions, etc.
  4. The Data Controller has the right to amend the Policy in whole or in part.
  5. Additions or changes to the Policy shall take effect when published on the Website.
  6. If after addition to or amendment of the Policy the person keeps on using the Website and/or the services provided by the Data Controller, it is deemed that the person does not object to such additions and or amendments.
